dc.descriptionThe fundamental pillar of transmission patrimoniale mortis causa constitutes it the right of succession option. It depends on his exercise who will become the heir of the deceased, how the wealth will be divided succession, the part that will belong to each heir, who will be responsible for the debts of the deceased, etc. A general rule of acquiring the succession consists in the fact that, in order to acquire it, the heir, either testamentary or legal, must accept it. Acceptance of the succession is a unilateral legal act by which the heir expresses his own will to receive the inheritance and, respectively, to become in the future the owner of the inherited property. But the acceptance of the inheritance is not obligatory, it is the right of the person to accept or not, by renunciation, the legislator leaves it to the holder to manifest his legal interest.
